§ 1 GENERAL PROVISIONS

  1. The online store www.privatedreambox.com operates in accordance with these Terms and Conditions.

  2. These Terms define:

    • rules for concluding and terminating Sales Agreements,

    • complaint procedures,

    • types and scope of electronic services,

    • rules for providing such services.

  3. Each Service Recipient is obliged to comply with these Terms when using the Store.

  4. All agreements concluded via the Store are governed by Polish law. Consumers may rely on more favorable provisions applicable in their country of residence.

  5. In matters not regulated herein, the following apply:

  4. Contact Form – form enabling contact with the Service Provider.

  5. Registration Form – form enabling Account creation.

  6. Account – user account storing personal data and Orders.

  7. Order Form – form enabling submission of Orders.

  9. Service Recipient – any entity using the Electronic Service.

  10. Customer – Service Recipient entering or intending to enter a Sales Agreement.

  11. Consumer – natural person acting outside business activity.

  12. Entrepreneur – entity conducting business activity.

  13. Product – movable item offered in the Store.

  14. Sales Agreement – agreement between Customer and Seller.

  15. Order – Customer’s declaration of intent to purchase.

  16. Price – monetary value payable for the Product.


§ 3 PRODUCTS AND ORDERING

  1. The Store sells Products via the Internet.

  2. Products are:

    • new,

    • compliant with agreements,

    • legally placed on the EEA market.

  3. Website content does not constitute an offer. Orders are offers made by Customers.

  4. Prices:

    • in PLN,

    • include VAT,

    • exclude delivery costs.

  5. Price is binding at the time of Order placement.

  6. Promotions include information about the lowest price in the last 30 days.

  7. Orders can be placed 24/7 via the website.

  8. Account registration is required to place Orders.

  9. Acceptance of these Terms is required.

  10. Orders are processed:

  • Monday–Friday, 08:00–16:00

  • Outside these hours → next business day

  1. Promotional Products are limited in quantity.


§ 4 CONCLUSION OF SALES AGREEMENT

  1. The Customer submits an Order via the Store.

  2. The Seller confirms receipt.

  3. Confirmation is binding and sent by email.

  4. Confirmation includes:

    • Order details

    • withdrawal form

    • Terms and Conditions

  5. Contract is concluded upon receipt of confirmation.

  6. Proof of purchase (receipt/invoice) is provided.


§ 5 PAYMENT METHODS

    • bank transfer

    • PayPal

    • cash on delivery

    • shipping: 3–6 business days

    • maximum: up to 10 days in exceptional cases

  3. Delivery via courier.


§ 7 COMPLAINTS

1. Warranty

  • Selected Products include manufacturer warranty (12 months).

  • Proof: warranty card or receipt.

  • Warranty does not exclude statutory rights.


2. Non-conformity

  • Governed by Consumer Rights Act and Civil Code.

    • response within 14 days

  • Customer rights:

    • repair or replacement

    • price reduction or withdrawal (under conditions)

§ 8 RIGHT OF WITHDRAWAL

  2. Product must be returned within 14 days.

  2. Seller may withdraw within 14 days.

  3. Seller may require prepayment.

  4. Risk transfers upon handover to carrier.

  5. Customer must inspect shipment.

  6. Service Provider may terminate services immediately.


§ 10 ENTREPRENEURS WITH CONSUMER RIGHTS

  1. Applies to sole traders under specific conditions.

  2. Rights include:

    • unfair terms protection

    • non-conformity claims

    • withdrawal rights

  3. Professional nature excludes protection.

  4. No institutional consumer protection applies.

§ 14 TERMINATION

    • by Provider for violations (7-day notice)

  2. Invalid provisions replaced by applicable law.

  3. Disputes:

    • first amicable resolution

    • then court

  4. Jurisdiction:

    • Consumers → competent courts

    • Businesses → Seller’s court

  5. Consumers may use ADR (including UOKiK).
